These terms govern your use of the NESMATRIX website and products. By creating an account, starting a trial, or using the services, you agree to them. Please read them — especially the disclaimers and the limitation of liability.
These terms are an agreement between you (and the organisation you represent) and NESMATRIX Private Limited. If you are accepting them on behalf of an organisation, you confirm you have the authority to do so.
A few words mean something specific here:
You must be at least 18 and able to enter a contract. Keep your login details secure, make sure your account information is accurate, and tell us promptly if you suspect unauthorised access. You are responsible for activity under your account.
Use the Services lawfully and reasonably. You agree not to:
Paid plans are billed in advance — monthly or annually — at the price shown when you subscribe. Subscriptions renew automatically for the same period unless you cancel before the renewal date. Plan changes are prorated. Fees are non-refundable except where the law requires otherwise or we say so in writing. Taxes may apply on top of listed prices.
We may offer a free trial. At the end of the trial, a paid plan begins only if you choose to continue — we will not charge you without your action. Trials are provided as-is and may have feature or usage limits.
You own your Customer Data. You grant us the limited rights we need to host and operate the Services for you, and we handle personal information as described in our Privacy Policy. We treat your Customer Data as confidential and will not access it except to provide support, maintain the Services, or as the law requires. You can export your data while your account is active.
The Services, including their software, design, and content, belong to NESMATRIX and our licensors. We grant you a limited, non-exclusive, non-transferable right to use them during your subscription. The NESMATRIX name and marks are ours; please don't use them without permission.
Some NESMATRIX work and software support scientific research and analysis. Any outputs, models, predictions, or analytics are provided for research and decision-support only. They are not medical, clinical, diagnostic, legal, or financial advice, and they are not a substitute for professional judgement or regulatory approval. You are responsible for how you use them.
We work hard to keep the Services available and provide support at the level included in your plan. From time to time we may need to perform maintenance or make changes, and we will give reasonable notice for anything significant.
The Services are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or fit every use you have in mind.
To the fullest extent permitted by law, NESMATRIX will not be liable for indirect, incidental, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Services is limited to the amount you paid us for the relevant Service in the 12 months before the claim arose.
You agree to cover reasonable claims, losses, and costs that arise from your misuse of the Services, your Customer Data, or your breach of these terms — to the extent the law allows.
You can cancel your subscription at any time from your account. We may suspend or end access if you breach these terms or use the Services in a way that risks harm. When an account ends, your right to use the Services stops; we will make your data available for export for a reasonable period before deleting it.
These terms are governed by the laws of India. The courts of Bengaluru, Karnataka have exclusive jurisdiction over any dispute, unless mandatory local law gives you other rights.
We may update these terms as the Services and the law change. When we make material changes, we will update the date above and let you know. Continuing to use the Services after a change means you accept the updated terms.
